Terms of Service

These Terms of Service (“Terms”) govern your access to and use of https://mydingerlab.com and any purchases you make from Dinger Lab (“Dinger Lab,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to make a purchase — or have the involvement of a parent or guardian. By ordering, you represent that the information you provide is accurate and that you are authorized to use the payment method.

2. Products, descriptions & availability

We try to display our products and their colors, sizes, and details as accurately as possible. Actual colors and print placement may vary slightly because many items are printed on demand and because of differences in screens and manufacturing. Products are subject to availability, and we may limit quantities, discontinue items, or correct errors at any time.

3. Pricing & errors

Prices are shown in U.S. dollars and may change at any time before you order. Shipping and applicable taxes are calculated at checkout. Despite our efforts, a product may occasionally be mispriced or described inaccurately; if so, we may cancel or refuse any order placed for that item, even after an order confirmation, and will refund any amount charged.

4. Orders & acceptance

Your order is an offer to buy. Our acceptance occurs when we send an order confirmation and/or ship the items; until then we may decline or cancel an order (for example, for suspected fraud, errors, or stock issues) and refund any charge. Keep your confirmation for your records.

5. Payment

Payments are processed securely by Stripe. By submitting payment, you authorize us (through Stripe) to charge your payment method for the total order amount, including products, shipping, and taxes. You are responsible for any charges incurred under your account or payment method.

6. Shipping & delivery

We currently ship to the United States and Canada. Production and delivery times are estimates and are not guaranteed; many items are made to order, so please allow time for production before shipping. Risk of loss passes to you on delivery to the carrier. You are responsible for providing an accurate shipping address — see our Returns & Refunds Policy for address errors and undelivered packages.

7. Returns & refunds

Returns, replacements, and refunds are governed by our Returns & Refunds Policy, which is incorporated into these Terms.

8. Intellectual property

The Site and its content — including the Dinger Lab name, logo, designs, text, graphics, and product artwork — are owned by us or our licensors and are protected by intellectual-property laws. You may not copy, reproduce, sell, or create derivative works from our content or designs without our written permission.

9. Reviews & user submissions

If you submit a review, comment, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and adapt it in connection with the Site and our marketing. You represent that the content is yours to share and is accurate, and that it does not violate any law or third-party right. We may moderate, edit, or remove submissions at our discretion, and we do not guarantee that any submission will be published.

10. Acceptable use

You agree not to:

  • Use the Site for any unlawful, fraudulent, or harmful purpose;
  • Interfere with or disrupt the Site, its security, or its infrastructure;
  • Attempt to access areas or data you are not authorized to access;
  • Scrape, harvest, or misuse content except as expressly permitted; or
  • Submit content that is unlawful, infringing, defamatory, or abusive.

11. Third-party services

We rely on third parties such as Stripe (payments) and Printify (production and fulfillment). Your use of the Site may be subject to their terms as well. The Dinger Lab training app at https://app.mydingerlab.com is a separate service governed by its own terms.

12. Disclaimers

The Site and products are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free.

13. Limitation of liability

To the fullest extent permitted by law, Dinger Lab and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

14. Indemnification

You agree to indemnify and hold harmless Dinger Lab from any claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

15. Governing law & disputes

These Terms are governed by the laws of the State of Arizona and applicable U.S. federal law, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Arizona, and you consent to their jurisdiction, except where applicable law provides otherwise.

16. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted here with a new “Last updated” date and applies to use of the Site after it is posted.

17. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding the Site.
